Warranty and Guarantee

For warranty claims, clients must notify us in writing within the warranty period, providing detailed information and evidence of the issue. We will then arrange for an inspection and necessary corrective measures at no additional cost.

Liability

  • Total Liability: Our liability is limited to the total amount paid by the client for the specific project. We are not liable for indirect, incidental, or consequential damages that may occur as a result of our services.
  • Insurance: We maintain comprehensive liability insurance to cover potential damages or accidents that may arise during the restoration process.
  • Force Majeure: We are not responsible for delays or damages caused by unforeseeable events beyond our control, such as natural disasters, strikes, or government restrictions.

Permits and Regulations

Compliance with local laws and regulations is mandatory for all restoration projects. Our permitting and regulations section includes:

  • Permits: Depending on the project scope, certain permits may be required. We assist our clients in identifying and obtaining necessary permits to ensure legal compliance.

  • Responsibility: Clients are responsible for any additional costs or paperwork related to permits that may arise due to unforeseen requirements.

Client Responsibilities

To ensure the successful execution of driveway restoration, clients must fulfill the following responsibilities:

  • Access: Ensuring unobstructed access to the driveway area for our team and equipment during the project duration.

  • Communication: Maintaining open and prompt communication with our team to address any questions, concerns, or changes throughout the project.

Changes and Cancellations

Flexibility is important, and we accommodate changes and cancellations under the following terms:

  • Change Orders: Any modifications to the original scope of work, such as additional services or alterations to the design, must be documented in a change order agreement. Additional costs will be assessed based on the nature and extent of the changes.
  • Cancellations: Clients may cancel the project by providing written notice at least 14 days before the scheduled start date. Cancellations made within this timeframe will incur a cancellation fee equivalent to the deposit paid.
  • Rescheduling: We strive to accommodate rescheduling requests; however, availability is subject to our current project load. Rescheduling may result in additional fees if requested after the project start date.
  • No-Show: Failure to show up for the scheduled start date without prior notice will result in a charge equivalent to the deposit to cover prepped resources and scheduling costs.

Dispute Resolution

In the unlikely event of a dispute, the following dispute resolution process will be followed:

  • Negotiation: Both parties agree to engage in good-faith negotiations to resolve the issue amicably and promptly.
  • Mediation: If negotiations fail, a neutral third-party mediator will be introduced to facilitate a mutually acceptable resolution.
  • Arbitration: Should mediation not result in a satisfactory outcome, the dispute will proceed to binding arbitration as per the governing laws, with both parties agreeing to abide by the arbitrator’s decision.
  • Legal Action: Legal proceedings will only be pursued as a last resort, following the completion of negotiation, mediation, and arbitration steps.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which the services are provided. Any legal actions arising from or related to these terms shall be filed in the appropriate courts within the same jurisdiction. This governs all aspects of the agreement, including its formation, execution, and interpretation.

Confidentiality

We respect the confidentiality of our clients. All information provided by the client during and after the restoration project will be handled with strict confidentiality. We will not disclose personal or project-related information to third parties without the client's explicit consent, except as required by law.

Intellectual Property

Any designs, plans, or materials developed during the driveway restoration project are considered the intellectual property of the service provider unless otherwise agreed upon in writing. Clients are granted a limited license to use the materials for their personal purposes, and any commercial use requires prior written permission.

Termination

Either party may terminate the agreement under the following conditions:

  • Material Breach: A significant violation of the terms by either party that remains unaddressed after written notice will result in termination of the agreement.
  • Mutual Agreement: Both parties may agree to terminate the agreement at any time, provided that the terms of termination are documented in writing and any outstanding obligations are fulfilled.
  • Immediate Termination: In cases of illegal activities, fraud, or other serious misconduct, the agreement may be terminated immediately without prior notice.

Upon termination, any work completed up to the termination date will be invoiced, and applicable fees will be owed by the client as per the payment terms outlined above.

Force Majeure

Neither party shall be held liable for any failure to perform its obligations under these Terms and Conditions if such failure is caused by circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters such as earthquakes, floods, or hurricanes.
  • Acts of government, war, terrorism, or civil unrest.
  • Pandemics or significant public health emergencies.
  • Power outages or failures of critical infrastructure.

In the event of a force majeure, the affected party must promptly notify the other party and provide reasonable evidence of the occurrence. Both parties agree to discuss and agree upon any necessary adjustments to the project timeline or terms to accommodate the impacted situation.

Amendments

These Terms and Conditions may be amended or updated from time to time to reflect changes in legislation, business practices, or other relevant factors. Clients will be notified of any amendments in writing, and continued use of our services constitutes acceptance of the updated terms.
